1. Purpose of This Form

This form documents the customer’s acknowledgment of product use limitations, emissions compliance responsibility, installation responsibility, and legal obligations related to the purchase, installation, possession, or use of certain aRacer products.

This form is intended to be completed by the customer at or before the time of sale and retained by the selling dealer for recordkeeping purposes.


2. Who This Form Applies To

This form applies to:

  1. All authorized aRacer dealers selling applicable products to retail customers, shops, racers, builders, tuners, installers, or end users.
  2. All customers purchasing applicable products from an authorized aRacer dealer.
  3. All drop-shipment sales where an authorized dealer sells the product to a customer and aRacer SpeedTek ships the product directly to the customer.
  4. All installation or tuning sales where the dealer sells, installs, configures, tunes, or assists with an applicable product.

3. Products This Form Applies To

This form must be completed for the sale of any product that may affect, modify, replace, control, alter, or support engine management or emissions-related operation, including but not limited to:

  • ECUs
  • Fuel controllers
  • Ignition controllers
  • Engine control modules
  • Programmable engine management systems
  • Throttle, fuel, ignition, or emissions-related tuning devices
  • Products sold for racing, testing, development, off-road, or closed-course competition use
  • Any product identified by aRacer SpeedTek or aRacer ECU R&D of America LLC as requiring customer acknowledgment

This form is especially required for ECU products and other emissions-sensitive products.

This form is not generally required for ordinary merchandise or non-control accessories unless requested by aRacer SpeedTek, required by law, or required by the dealer’s own internal policy.


4. Dealer Recordkeeping Requirement

The selling dealer must keep a completed copy of this form on file for a minimum of three (3) years from the date of sale.

The dealer may retain the form in paper or digital format, provided that the record is complete, readable, and reasonably accessible if needed.

Upon request, the dealer agrees to provide a copy of the completed acknowledgment to aRacer SpeedTek / aRacer ECU R&D of America LLC for compliance, warranty, support, dispute resolution, or legal review purposes.

8. Customer Acknowledgments

By signing this form, customer acknowledges and agrees as follows:

A. Product Use

Customer understands that some aRacer products are intended for closed-course competition, off-road, racing, testing, research, or development use only where applicable.

Customer is responsible for determining whether the product may be legally purchased, installed, possessed, sold, resold, or used in customer’s jurisdiction and application.

B. Emissions Compliance

Customer understands that the product is not represented as CARB-approved, EPA-certified, or legal for use on pollution-controlled vehicles operated on public highways unless specifically stated in the product listing or official documentation.

Customer understands that installation or use of certain products on emissions-controlled vehicles may be restricted or prohibited by federal, state, provincial, local, or other applicable laws and regulations.

Customer accepts full responsibility for compliance with all applicable emissions, vehicle, highway, racing, off-road, environmental, and consumer protection laws.

C. No Street-Legal Representation

Customer acknowledges that neither the dealer nor aRacer SpeedTek / aRacer ECU R&D of America LLC has represented that the product is street legal, emissions legal, CARB-approved, EPA-certified, or legal for highway use unless such approval is specifically stated in the official product listing or documentation.

D. Installation and Tuning Responsibility

Customer understands that proper installation, configuration, wiring, calibration, tuning, and use are critical to product performance and vehicle safety.

Customer acknowledges that improper installation, wiring, tuning, use, abuse, modification, or unauthorized calibration may cause engine damage, vehicle damage, product failure, injury, regulatory violation, or warranty denial.

Customer accepts responsibility for having the product installed and configured by a competent person or qualified professional.

E. Warranty and Support

Customer understands that warranty, return, replacement, or support claims must follow the applicable aRacer SpeedTek / aRacer ECU R&D of America LLC process.

Customer understands that the dealer may not approve warranty coverage, returns, replacements, or legal claims on behalf of aRacer SpeedTek / aRacer ECU R&D of America LLC unless specifically authorized.

F. Assumption of Responsibility

Customer assumes responsibility for the purchase, installation, possession, use, resale, and application of the product.

Customer agrees not to hold the selling dealer, aRacer SpeedTek, or aRacer ECU R&D of America LLC responsible for unlawful use, improper installation, unauthorized modification, emissions violations, misuse, or use outside the product’s intended purpose.


 

9. Customer Certification
